AREA OF JURISDICTION (see map)

The Cebu Maritime Regional Office area of jurisdiction covers the whole of Region VII comprising the provinces of

Cebu, Bohol, Negros Oriental and Siquijor.

  • Franchising Function

  1. To issue CPC, PA and SP in uncontested applications to liner and tramping vessels, operating intra-regionally and interregionally; PROVICED, that the vessels are homeported in the ports located within the respective regional boundary of the cognizant MRO as defined by MARINA issuances, and in contested applications to liner services operating intra-regionally, PROVIDED, that the vessels are homeported in the ports within the area of jurisdiction of the concerned MRO. Pending issuance of a CPC, a PA maybe issued with a maximum validity period of one (1) year and it shall be incumbent upon the MRO to render a decision on the basic application for CPC on or before the expiry date of the PA issued, except in cases where the cause of delay in the issuance of a CPC is attributed to the applicant/petitioner, PROVIDED, HOWEVER, THAT the validity of the PA to be issued to vessels required to be classed and are still in the process of being classed shall be dependent on the guidelines under Office Order Nos. 014-93/014-93-A;

  2. To hear contested applications for CPC to liner vessels operating inter-regionally, provided that the vessels are homeported in the ports within the respective regional boundary of the cognizant MRO as defined by MARINA issuances, and after hearing, to forward the records of the case to the MARINA Central Office with the appropriate table of contents, the proceedings taken, MRO's comments, and recommendations thereon, for final resolution, decision and issuance/denial thereof;

  3. To issue SP when necessary, but not exceeding thirty (30) days, for temporary vessel replacement/substitution due to emergency/annual dry-docking or other special circumstances, such as but not limited to fiestas, peak seasons, holidays, or emergency/calamities; or to make special excursion trips outside of its own territory or franchised area/ports if the public interest require it; PROVIDED, however, that in case a public service cannot render such extra service on its own line or in its own territory, an SP for such extra service may be granted to any other public service; PROVIDED FINALLY, that a notice to the authorized existing operator is filed no less than three (3) days before the replacement/substitution/special trip is initiated;

  4. To approve the sale of vessel alone or sale and transfer of vessels and franchise PROVIDED, that, the sale/transfer of vessel is uncontested and subject vessel is homeported within their regional boundaries, PROVIDED HOWEVER, THAT, no sale or transfer of franchise without a vessel can take place;

  5. To exempt vessels from securing CPC pursuant to Section 13 (a) and Section 14 (b) of the Public Service Law (CA 146, as amended) and Sec. (V) 5, MARINA MC No. 104, s. 1995;
    To issue, upon written instruction of the Administrator a letter directive, to ship operators to provide immediate shipping services under the provisions of Sec. 12 (d) of PD No. 474, for a period not exceeding 30 days. Extension thereof shall be issued upon consultation with, and prior clearance from the Administrator;
    To cause the issuance of SCO and/or Cease and Desist Order (CDO), against any ship operator or public water service operator, or as a result of the investigation conducted by the Authority upon its own initiative, or who have been found in violation of the Public Service Law and other relevant MARINA Circulars/Rules and Regulations, or Orders and directives of the Authority, the enforcement/implementation of which have been delegated to the MRO's, or who have committed any violation/infraction of the terms and conditions of the CPC/PA/SP, and to hear, decide and impose administrative fines appurtenant thereto based on pertinent MARINA MCs; PROVIDED, however, that in compromise penalties, the records of the case with appropriate table of contents, the proceedings taken, MRO's comments and recommendations thereon will be forwarded to the MARINA Central Office for final resolution or decision in accordance with MC No. 74-A;

  6. To issue PA/SP, upon written instruction of the Administrator or his duly authorized representative, in favor of the applicants/petitioners for CPC, whose applications/petitions have been approved by the MARINA Board; and

  7. To perform such other functions as may from time to time, be required by the Management or the Board, including, but not limited to, monitoring and enforcement of the terms and conditions of the CPC/PA/SP, MCs, Order and other issuance of MARINA.

  8. Hearings in all the foregoing quasi-judicial cases shall be in accordance with the provisions of MARINA MC No 74-A, s. 1995.

  • Manpower Development Function

  1. To issue Qualification Document Certification (QDC) to seafarers serving the vessels engaged in domestic trade pursuant to MARINA Memorandum Circular No. 164.

  2. To cause the inspection of both ocean-going (both RP and foreign flags) and domestic vessels, only by the authorized/qualified MARINA Enforcers pursuant to the pertinent provisions of the 1978 STCW Convention and its 1995 Amendment and MARINA MC Nos. 47 & 47-A, PROVIDED, that no vessel shall be detained on any ground under the STCW Convention without the written Order from the Administrator, and

  3. To issue Seafarer's Identification and Record Book (SIRB) to seafarers both for overseas and domestic trades, pursuant to the provisions of MARINA MC No. 163.

  4. To authenticate maritime upgrading certificates issued by maritime training centers in the region.

  • Licensing/Registration of Shipbuilders and Shiprepairers

  1. To issue original and renewal of SBSR/Afloat Repair/Boatbuilding/Shipbreaking Licenses under MARINA MC No. 95 s. 1994.

  • Other Functions

  1. To issue Authority to Import for applications for the importation of marine engines, spare parts, and other vessel appurtenances;

  2. To indorse incorporation papers of proposed Corporations and Partnerships for Approval/Registration of Articles of Incorporation/Partnership by the SEC;

  3. To issue Accreditation Certificates for banca operators per MARINA MC No. 79-A;

  4. To issue pertinent Certificates, Permits/Licenses pursuant to the other mandated tasks under EO 125/125-A, to wit:

  • Certificate of Vessel Registry (for domestic/fishing vessels)

  • Certificate of Number (for vessels 3 GRT and below) ***

  • Certificate of Ownership

  • Certificate of Inspection/Interim Certificate of Inspection (for domestic and fishing vessels) ***

  • Permit to Operate/Special Certificate of Inspection (for vessels 3 GRT and below) ***

  • Dispensation Permit ***

  • Certificate of Deletion from Philippine Registry

  • Special Permit to Operate Vessel Without Licensed Patron/Engineer ***

  • SOLAS Certificates ( Ship Safety Equipment Certificate, Ship Safety Construction Certificate and Exemption Certificate) in accordance with the International Convention for SOLAS 1994 and its amendments;
    CWL/BRL/PYL for all domestic vessels, and ***

  • MBOL for operators of vessels 3 GRT and below ***

Administrative Order No. 19-98 by Administrator PH Garrido:

  • Undertake evaluation of applications for vessel importation pursuant to Administrative Order No. 104 re: Omnibus Guidelines for the Acquisition of Vessels for Domestic Operations and Fishing Vessels/Boat. Subject applications will be forwarded to the Administrator for approval. (Note: Not yet implemented)
